Access-A-Pal is a risk mitigation service. It is designed to reduce common website accessibility barriers and to keep records of ongoing effort. It does not guarantee that any website conforms to the ADA, WCAG, Section 508, the European Accessibility Act or any other law or standard, and it does not guarantee protection from demand letters, complaints, claims, regulatory action or lawsuits.
LOJO is not a law firm, and the LOJO team are not attorneys. Nothing provided through Access-A-Pal is legal advice.
These Service Terms govern your use of Access-A-Pal, a website accessibility service provided by LOJO Group, LLC, doing business as LOJO Marketing and Access-A-Pal ("LOJO," "we," "us"). By starting a free trial, ordering a plan, or installing the Access-A-Pal code, the business placing the order ("Client," "you") agrees to these terms. Your agreement begins on the date you first do any of these.
1.1 Access-A-Pal covers only the website or websites listed in your order. Each website requires its own plan.
1.2 The service includes an accessibility toolbar, automated adjustments intended to support screen readers and keyboard navigation, recurring automated scans, periodic accessibility reports, and a template accessibility statement. Features may be updated over time.
1.3 Remediation of content at its source, such as captions, transcripts, PDF conversion, theme or code changes, and manual reviews, is not part of the service and is available only under a separate written quote.
2.1 Free trials last 7 days unless your order states otherwise. If you do not choose a plan by the end of the trial, the service may be turned off.
2.2 Monthly plans renew automatically each month until canceled. Annual plans renew automatically each year. Promotional pricing, including any first-year annual price, applies only to the period stated, and renewals are billed at the then-current rate.
2.3 You may cancel with at least 30 days' written notice. Service continues, and fees remain due, through the end of the notice period.
2.4 We may change fees with 30 days' notice. You may cancel before a change takes effect.
3.1 You own and control your website, its content and its data practices, and you may work with other vendors on it.
3.2 You agree to keep the Access-A-Pal code installed as provided, give us reasonable notice of major website changes, provide accurate information, and maintain any access we need to support the service.
3.3 You are responsible for complying with the laws that apply to your business and website, and for obtaining any legal advice you need.
4.1 Fees are billed in advance for each monthly or annual period.
4.2 Card payments carry a 3% processing fee, which may be waived for ACH payments. Late payments may incur late fees.
4.3 If payment is not received, we may suspend the service. While suspended, the toolbar, automated adjustments, scans and reports may stop working.
Fees do not include taxes. You are responsible for applicable taxes, and we may add any taxes we are required to collect.
6.1 LOJO is not a law firm, and the LOJO team are not attorneys. Our website, reports, accessibility statement template, scans, support conversations and other materials are general information, not legal advice.
6.2 Access-A-Pal is intended to reduce risk, not eliminate it. We do not guarantee that your website conforms to any accessibility law, regulation, guideline or standard, or that you will not receive a demand letter, complaint, claim, regulatory inquiry or lawsuit.
6.3 Automated technology has limits. Automatically generated adjustments, including image descriptions and labels, may be incomplete or inaccurate, and some content, such as video, audio, PDFs, images of text and third-party embeds, may not be addressed.
6.4 Reports, scores and accessibility statements are informational. They are not a certification, audit opinion or legal opinion.
On request during your active service, we will provide copies of available reports and scan history for your website. We do not provide legal representation, legal defense, testimony or expert witness services.
The service depends on the Access-A-Pal code remaining installed and working as provided. We are not responsible for results affected by changes we did not make, including changes by you, your other vendors, your website platform or your hosting provider.
When service ends, the toolbar, automated adjustments and scans stop, and you are responsible for removing the code from your website. Free trial periods aside, fees for past periods are not refundable.
Access-A-Pal is licensed to you for use on the covered websites during your active service. It is not sold. All rights in the software, reports format and materials remain with LOJO and its licensors. You authorize us to scan and analyze the covered websites to provide the service.
Access-A-Pal is designed to analyze page structure and behavior rather than to collect personal information about your visitors. Our handling of information is described in our Privacy Policy.
Except as stated in these terms, the service is provided "as is" and "as available," without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.
13.1 You are solely responsible for your website, its content and its data practices, and for any claims, fines or litigation arising from them.
13.2 You agree to indemnify and hold harmless LOJO, LOJO Group, LLC, and their owners, employees and contractors from any claims, losses, damages and expenses, including reasonable attorneys' fees, arising from your website, its content, your use of the service, or your breach of these terms.
14.1 To the fullest extent allowed by law, LOJO's total liability for any claim related to Access-A-Pal is limited to the fees you paid for the affected website in the twelve months before the claim arose.
14.2 LOJO is not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, settlement amounts, legal fees in claims brought against you, or loss of data.
In any dispute to enforce these terms, the prevailing party may recover its reasonable attorneys' fees and costs.
The service relies on technology we do not control, including browsers, assistive technologies, website platforms, hosting providers and payment processors. Their changes or outages are not a breach of these terms by LOJO.
These terms are governed by the laws of the State of Tennessee. Any dispute will be brought in the state or federal courts located in Wilson County, Tennessee.
We may update these terms from time to time. The updated terms apply from the date posted, and continued use of the service after that date means you accept them.
These terms, together with your order and our Privacy Policy, are the entire agreement for Access-A-Pal. If any part is found unenforceable, the rest remains in effect. A failure to enforce any part is not a waiver.
